Saw the legal notice in this week's Glen Rose Reporter newspaper about how the TCEQ has issued a *preliminary* permit for Tommy Davis of Slick Machines to run his rock-crushing operation at a property by Chalk Mountain (You can see where this is if you go towards Stephenville and then look to the right, where the hill is being stripped of trees and his permit information is out by a dusty road on 67).
I notice that, while others can still file comments, it's getting down to the wire where IF there's a person who actually lives right by there and would be affected, that person(s) could ask for a contested case hearing. The other possiblity is that Sid Miller (Tx House District 59) could ask for one. I'll bet he does and if so, the TCEQ would HAVE to hold a contested case hearing.
One reason why it matters that you, the reader, if you have not submitted a comment about the whole thing yet, DO submit a comment is that
A contested case hearing will only be granted based on disputed issues of fact that are relevant and material to the Commissions' decisions on the application. Further the Commission will only grant a hearing on issues raised by you or others during the public comment period and have not been withdrawn. Issues that are not raised in public comments may not be considered during a hearing.
