I've not ever been to an appeals court before so I thought it would be good to drive down and watch the proceedings. Basically, Judge Bridewell of the 249th District entered a summary judgment to dismiss Ogletree's case against GRISD. I thought I had scanned this, but apparently not. At any rate, that summary judgement happened sometime late in 2008, as I recall. Ogletree appealed that decision and on Wednesday of this week (the 13th) her attorney and the attorney for GRISD gave oral arguments on the matter. As you might expect, Ogletree's attorney asked for the summary judgement to be overturned and the GRISD attorney asked for it to be upheld. I did take some extensive notes of the proceedings, but decided not to write them up here and rather, wait until after the court makes their decision.
Generally, however, on the proceedings themselves. The courtroom was in downtown Waco, nicely laid out, more wide than long, with several rows of chairs. The justices asked for the attorneys to do their presenations, which included some back and forth questioning at a discussion level. Basically, it seemed that each attorney was being asked, intellectually, to justify their positions, including court cases, precedents, etc. First Ogletree's attorney was up, then the GRISD attorney, then Ogletree's attorney had a rebuttal.
I understand it may take some more time, perhaps months, for a decision to come back.
