One of our regular readers pointed out that there is a difference between the violation information that we posted in mid-February, 2009 to what is posted now on the DADS website. I called up DADS to ask and am waiting a call back from Ardiana Gonzales to explain why there's a difference in what was cited. I assume that the report for 2008-2009 was this time frame, as the inspection was done on 2/13/2009.
Here's what I see today:
| | 2007 | 2008 | 2009 |
| | Inv | Sub | Inv | Sub | Inv | Sub |
| Facility | 3 | 0 | 5 | 3 | 1 | 0 |
| Texas Average | 7 | 2 | 7 | 1 | 0 | 0 |
| Date | Corrected | Deficiency | Residents Affected | Severity of Deficiency Least=1 ... 4=Most |
| 01/08/2008 | 01/11/2008 | The facility failed to ensure that the required sprinkler systems have an electrically supervised main control valve so that at least a local alarm will sound when the valves are closed. | Many | Minimal Harm or Potential for Actual Harm |
| 01/10/2008 | 01/29/2008 | The facility did not write and use policies that forbid mistreatment, neglect and abuse of residents and theft of residents' property. | Some | Minimal Harm or Potential for Actual Harm |
| 01/10/2008 | 01/29/2008 | The facility did not make sure that private space is available in the nursing home for resident groups or residents' families to meet. | Some | Potential for Minimal Harm |
| 01/10/2008 | 01/29/2008 | The facility did not 1) provide 3 meals daily at regular times; or 2) serve breakfast within 14 hours after dinner; or 3) offer a snack at bedtime each day. | Some | Potential for Minimal Harm |
| 01/10/2008 | 01/29/2008 | The facility did not 1) hire only people who have no legal history of abusing, neglecting or mistreating residents; or 2) report and investigate any acts or reports of abuse, neglect or mistreatment of residents. | Some | Minimal Harm or Potential for Actual Harm |
| 07/11/2008 | 08/08/2008 | The facility did not make sure that the nursing home area is free of dangers that cause accidents. | Some | Minimal Harm or Potential for Actual Harm |
Looks to me that the format of how information is changed a little.
What I don't understand is why, since they listed some of the deficiencies, they didn't list others, even though the dates were the same and included 2008. It also may be that they just rewrote, in a different way, the deficiencies from the earlier report.Or that they just took the federal deficiences and didn't put in the state ones.
For example: The first on the new list, about the sprinkler system went from general to specific (needs an electrically supervised main control valve). The second is about writing (they didn't) and using policies that forbid mistreatment, neglect and abuse of residents, and theft of resident's property. The fhird is about failling to provide private space for residents or their families. Those and the next two, match exactly the violations of federal standards.
But what's missing are the state violations that are on the earlier link, but not shown now on the DADS website. For example.
| 01/10/2008 | 01/29/2008 | The facility failed to report immediately any alleged violations towards residents to the appropriate officials. |
| 01/10/2008 | 01/29/2008 | The facility failed to provide evidence that all alleged violations are investigated and further abuse prevented. |
That's from the Feb link. Again, I await a call from the person who updated the website to ask why. Did they stop trying to parse out and put ALL the complaints and violations, whether they were state or federal and just roll them into one entity?
