Texas Legislature 30 day Session for School Funding Started Today

If lawmakers fail to reach a consensus again, many K-12 schools may not have enough money to open their doors to Texas' 4.3 million students when the new school year starts in August.

Republican Gov. Rick Perry vetoed $35.3 billion in public education spending in an effort to force lawmakers into finally resolving the issue during the special session, something they've failed to do during the last two regular sessions and a special session last year.....

Texas' public schools are mostly funded by local property taxes. The state's share of school spending has fallen off significantly in recent years while property taxes have increased. Many cash-strapped districts are taxing at the legal limit —

— $1.50 per $100 of property value — with no room to raise more money.

If property taxes are lowered, the state would need another source of money to invest in schools. Perry's plan suggests raising the state sales tax rate from 6.25 percent to 6.95 percent and expanding it to certain services; increasing the cigarette tax by $1 per pack, up from the current 41 cents per pack; and closing loopholes in the state's 4.5 percent franchise tax that an estimated five in six Texas businesses now avoid paying.

The Senate proposed increasing the sales tax to 6.75 percent, while the House proposed a 7.25 percent rate. Democratic senators balked at raising the rate more than a half cent because of the burden it would place on the poor.

In what may be an indication of the session's future, House members today filed an education reform bill and expected to file a tax bill that mirrored the proposals they delivered to the Senate during the final days of the regular session. Senate leaders called those proposals take-it-or-leave-it ultimatums that ended the negotiating process.

Many lawmakers campaigned on promises to lower school property taxes. They're also under court pressure to fix the school funding system after a judge last year ruled the system unconstitutional. The state has appealed the ruling, and a July 6 date is set for oral arguments before the Texas Supreme Court.
