Booty Bill aka Stopping Suggestive Cheerleading in Texas Fails in the Texas Senate

No Pom-Poms in the Senate

"We will not be hearing it," committee chairwoman Sen. Florence Shapiro said Friday.

"We have some very important work to do in the next two weeks, and that's not one of them," said Shapiro, R-Plano.

Rather than being a "mandate from the state," she said, the problem of students performing suggestive acts should be addressed by parents and school districts. Nicknamed the "booty bill," the proposal would have given the state and school districts more power to punish drill teams, dance groups and cheerleading squads who, during school-sponsored events, performed sexually suggestive acts and dressed too provocatively.

The bill said that if a district determined that an act was conducted in an "overtly sexually suggestive manner," school officials would be required to take "appropriate action" against the performers and their sponsor.

The measure passed the House by a nine-vote margin. But since going to the Senate, not one senator has offered to be its water boy.

"My wife loved that bill," said state Sen. Kim Brimer, R-Fort Worth.

Brimer said his wife "lobbied me hard" to support it, then he reminded her that seductive cheering is not always a bad thing.

"I told her we had the Dallas Cowboy cheerleaders coming to Arlington. I'm not going to offend the Cowboys in any way," he said, referring to the team's decision to build a multimillion-dollar stadium in the city.

Even state Sen. Jane Nelson, a Flower Mound Republican and one of the more conservative senators, acknowledged that, with two weeks to go in the legislative session, lawmakers do not have time to clean up dirty dancing on school football fields and basketball courts.

"I think there are other bills that are so much more important right now," said Nelson, noting the Legislature's unfinished work on school financing, child protective services and a worker's compensation bill.

Nelson said she believes the "enthusiasm for the bill in the House" was caused, at least in part, by a "societal frustration" over a decline in morals, exhibited not only by students at school events, but also in TV shows and movies.
