About the Civil Case (249th District Ct) of Joelle Ogletree versus Glen Rose Independent School District

Just for the sake of adding a reference here to the civil case Ogletree has made against GRISD.  First up, here's the brief from GRISD in which they question some of Ogletree's pleadings on appeal. AFTER, here is the opinion of Tom Gray, Chief Justice, delivered on May 2, 2007 which is allowing the case, 10-05-00403-CV, against the district to go forth.

Ogletree brought suit against the Glen Rose Independent School District for breach of an employment contract, violations of Title 42 United States Code Section 1983, defamation, and other tort claims.  See 42 U.S.C. § 1983 (2000).  The trial court sustained the District's plea to the jurisdiction.  Ogletree appeals.  We affirm in part, and reverse and remand in part.

Conclusion. Having sustained Ogletree's second, third, and fourth issues, we reverse the trial court's judgment and remand as to Ogletree's breach-of-contract claim and claim under Section 1983, and otherwise affirm.

Am I out of line in suggesting that boys are more resilient than girls?  Please let the scientific facts reign, but it seems to me that the danger of a petting incident or the like from a woman, to a boy of age over 10 or 11 is not high.  On the other hand, we've had this devastating attack on the Roman Catholic Church in the U.S. so maybe boys aren't as tough as I imagine.  (Women under 35 are another thing -- I personally believe that most of them aren't resilient in sexual matters.)

   What I'm driving at is the School District, GRISD,  should have a policy depending on the facts of the case, and the actual damage suffered.  Apparently they don't, and that's why they're being sued.  Call it "lack of due process".  The psychiatrist or psychologist who advised them should be sentenced to retraining.

All schools have an adopted Board Poliicy on "due process" regarding the handling of grievances against employees.  From what I have seen, the current lawsuit appears to question whether this employee was given the same due process as any other would be.
