Pipeline Condemnations In Weatherford (Parker Co, TX) and What Does Phil King Have to Do With that?

30 August 2007 at 11:40:06 AM

Since pipeline companies are classified as *common-carrier*, they can condemn or forcibly take people's property. Yes, say that again, people's PRIVATE PROPERTY. So what happens if a pipeline company comes along and offers a price that the landowner doesn't think is fair? That person can appeal.

And that's what Rosa Bullington, who is represented by Phil King as attorney, did.

King said he became involved after he was asked to take the case by Alan Bullington, Rosa’s son. Alan Bullington happens to be senior vice president of international operations for Noble Energy, Inc., a $10 billion crude oil and natural gas company.

Phil King authored a bill in this last lege session that deals with this.

King authored a bill that would have allowed special commissioners and juries to consider best use value in condemnation cases across the state, but his efforts were thwarted by an eleventh hour veto from the Governor’s Office.

In reading the article, it seems there are different viewpoints on what a person's property should be valued at. It sure looks like the pipeline company, Enbridge Pipelines, tried to pull one over by comparing land values 10 MILES APART but the question is also about how does one judge the fair market value of a piece of land IF it is prime development property that might be worth a whole lot more in the future?
