Activist Judges? No, Activist Congress-Moves to Free Border Patrol Agents

Um. Isn't that what the JUDICIAL branch does? Why in the world is Congress interfering with the courts? I thought it was pretty smarmy when the Republicans (and a few Democrats like Chet Edwards) got involved with Shiavo, but I thought that type of thing would END once the Democrats got into power. This was NOT a vote by the Senate, but the House, where Democrats are a clear majority.

The House on Wednesday approved a move by conservative Republicans to try to set free two Border Patrol agents convicted of shooting a Mexican drug dealer.

After a long, emotional debate, the House voted by voice to block the Bureau of Prisons from keeping former agents Ignacio Ramos and Alonso Compean in federal prison. Ramos and Compean are serving 11- and 12-year federal prison sentences, respectively, for the 2005 shooting of Osvaldo Aldrete Davila on the Texas border near El Paso.

I'm not weighing in on whether the border patrol conviction was a good one or not, although it seems to me, after listening to Johnny Sutton speaking about it a couple of times, that it was. But it definitely is OUT OF LINE for CONGRESS to step in and basically do the same thing that Bush just did for Libby, which was to interfere with the judicial branch of our government.

And here's what else is smarmy about it- the Dems opted NOT to take a roll call vote.

Democrats such as Alan Mollohan of West Virginia opposed the attempt to free the two men, arguing that it is not Congress' place to interfere in criminal cases, particularly when they are under appeal as the Ramos and Compean case it.

But Democrats opted not to call for a roll call vote. It could be dropped from the bill during House-Senate negotiations this fall.

Adding- South Texas Chisme- US House Says It's Okay to Shoot Mexicans.

P.S. Let me say again how COWARDLY it is, especially when you look at all the other amendments in this same bill, most of which have a recorded vote, that Congress, INCLUDING DEMOCRATS, didn't have the guts to pony up that they are for this.

An amendment to prohibit the use of funds to enforce the judgement of the U.S. District Court for the Western District of Texas in the case of United States v. Ignacio Ramos, Et Al. decided March 8, 2006; or the sentences imposed.
