The Bush Whitewash Library at SMU and the Man With the Condo Who was Booted Out

Wrote about this before.  Eminent Domain Used to Take Someone's Property for (roads? some public works? Nope. The Bush Presidential Library at SMU).  But now the attorney who was booted out of his home has fought back. The idea is  "Did SMU know in the first place that it planned to try to take adjoining land through eminent domain?" SMU won't say, and the reason they have fudged is on the basis that the library hasn't technically been awarded to them. BUT, if Baylor will tell its plans, then SMU should have to.

A Dallas judge on Monday ruled Baylor University officials must answer questions about their closely guarded plans to land the George W. Bush Presidential Library, part of a long-running legal feud between front-runner Southern Methodist University and the former owner of a Dallas condo.

Dallas attorney Gary Vodicka in 2005 filed suit against SMU, alleging it engaged in fraud and intimidation in ousting residents of a condominium complex where he lived to make room for the library. As part of his suit, he has pushed for Baylor to unveil its plans for the library.

Vodicka acknowledges it’s a tactical move to force SMU to unveil its own library plans, which he contends go to the heart of his lawsuit. SMU has been tight-lipped about its plans, insisting that, in part, those plans are protected as a trade secret, Vodicka told the Tribune-Herald.

However, Vodicka says one requirement for information to be a trade secret is based upon the value of that information to competitors. Now that all proposals have been made and SMU has been named “sole finalist” for the Bush library, SMU’s proposal would be of no value to Baylor, as the lone remaining challenger for the library.

Here's what Vodicka's lawsuit is about.

He alleges SMU used fraud and intimidation to oust him from the University Gardens condos near campus in order to acquire the site for the Bush library.

SMU denies the allegations, but Vodicka has argued that SMU’s proposal for the library will show that the university always intended for the library to be built on the condo site.

SMU, however, has refused to release its proposal, claiming that it’s private and that it doesn’t want to share details with potential competitors.
