TCEQ Rejects 2 Dairy Permits Under Pressure from Senator Kip Averitt (SD 22)

Who wants phosphorous in their water? Nobody. But the TCEQ was taking FOREVER to issue environmental permits. Here's an article from 2004 that talks about the lawsuit the City of Waco had against dairies in the North Bosque watershed.

WACO ALLEGES

The City of Waco alleges damages by the 14 Bosque River dairies to their drinking water supply reservoir at Lake Waco. They claim Lake Waco has been adversely affected by an increase of nutrients, specifically phosphorus, resulting in excessive algae growth. They contend the excessive algae growth has caused taste and odor problems with their drinking water and they have incurred and will continue to incur substantial treatment costs in responding to the taste and odor problems. *Relief requested by the City of Waco seeks cost recovery and contribution for costs incurred by the city to address taste and odor problems in the lake.

The TCEQ has rejected applications by two dairies that were seeking permits to continue as “concentrated animal feeding operations,” or feedlot dairies with 200 or more cows. The Howle Dairy and Parks Lingleville Dairy must now scale back their herds to below 200.

Longtime critics of the TCEQ hailed the decision as the most aggressive step the agency has taken in the three-year permitting struggle in the environmentally impaired North Bosque watershed. Since mid-2004, all large dairies in the watershed have had to apply to renew their permits under stricter waste management rules tailored to the watershed. Waco city leaders and legislators hoped the stricter permits would reduce phosphorus pollution in downstream Lake Waco. But so far, only one of about 50 applicants has been issued a permit, so dairies continue to operate under the old rules.

TCEQ officials said one hang-up with the permits has been technical problems with the dairy applications, which deal with wastewater lagoons and wastewater application fields. The Howle and Parks dairies submitted inadequate applications and responded to subsequent queries with numbers that were “inaccurate and insufficent,” said L’Oreal Stepney, TCEQ water quality director.
