Texas HB 4052- Upper Trinity Groundwater Conservation District-NO Consideration to Include Oil and Gas Exemption

Here you are, trying to figure out how to conserve and regulate water usage in your district, and you've made legislation just for that. But you're FRUSTRATED because the house bill to create the district does NOTHING to regulate oil and gas water usage-BECAUSE that is regulated by the Texas Railroad Commission.

But each member of the court expressed some frustration at the proposed district’s inability to remove or diminish a long-standing oil and gas industry exemption.

“This is generally in line with what we thought it was going to be,” Brinkley said of House Bill 4052, which entered the House Natural Resources Committee Monday.

“But the exception I think we should take to this — and question whoever was involved in the legislation about — is what happened to any consideration of the oil and gas companies. If it’s not in here ... I think we have a responsibility to surface that.”

Wise County hired well-known lobbyist Brian Sledge to help craft district legislation. Brinkley and Webster met recently with Sledge and other affected county representatives in Austin. Brinkley said Sledge led them to believe the oil and gas industry would be willing to make some legislative concessions and that there would be room to negotiate.

In my opinion, the only way to fix this situation is to get the legislation changed ABOUT the RRC exemption and bring it inline with what the people want, not what favors oil and gas.
