Haskell Simon was alarmed when he first learned that under current Texas law a company could receive permission from the Texas Railroad Commission to inject oilfield waste to a level between 2,200 feet to 2,500 feet with no more than a 5-inch by 6-inch advertisement in the local newspaper and some paperwork.

At that injection level, oil field waste could easily be in the vicinity of the Evangeline Aquifer, which is the fresh water source for Matagorda County, Simon said. Simon is president of the Coastal Plains Groundwater Conservation District.

The site is just across the road from a new subdivision with about 15 “upscale homes,” and lots for about 65 homes in all, Simon said. Each home site will have a water well of its own, some below 800 feet. He notified each of the homeowners in the subdivision and other county officials about the injection well application.

In the meantime, Simon urged state representatives to support House Bill 521, which, if passed, will require companies to give notice to neighboring landowners of a proposed injection well site.

And after meeting with Simon, the bill’s author, Sid Miller, will amend the proposed bill to include notice to the county judge and the county water district of the proposed injection site, Simon said.

Just a note. The Somervell County Commisioners Court is readying a resolution that, when an injection well is noted in the paper, the county will protest to the Texas Railroad Commission. We have five commercial injection wells here already.
