Texans Join Suit Over NCLB

WASHINGTON — The nation's largest teachers union and school districts in Texas and two other states launched a legal fight over No Child Left Behind today, aiming to free schools from complying with any part of the education law not paid for by the federal government.

Donna New Haschke, president of the NEA-affiliated Texas State Teachers Association, said the law has become a tangled web of unfunded mandates and costly federal regulations that drain money from classrooms into complicated bureaucracy and expensive testing programs.

Kevin Lungwitz, TSTA's general counsel, said schools do not object to the law's goals, only the lack of funding associated with its mandates.

"The federal government has not provided the money it might take to give schools and students a fighting chance to succeed," he said.

The plaintiffs want a judge to order that states and schools don't have to spend their own money to pay for the law's expenses — and order the Education Department not to try to yank federal money from a state or school that refuses to comply based on those grounds.

Especially ironic given that Texas was the model for No Child Left Behind, despite the fact that Houston's "Zero Dropout" rate was a hoax. We ask yet again why Republicans, who traditionally have been against federal government interference in the states, are being bullies about an unpopular program foisted upon the states.
