TX House CPS Bill to privatize foster care, prevent homosexuals from being foster parents

Houston Chronicle: Private contractors would be responsible for placing abused and neglected children in foster homes and monitoring their progress under a Texas House plan lawmakers passed Tuesday to overhaul the state's Child Protective Services.The reform plan would represent a major shift for CPS by having the private sector take over the task of foster care placements and monitoring by 2011. It also includes an amendment that specifically disqualifies homosexuals from being considered as foster parents.

Here's  SB6 -

(4)  include an implementation plan to transfer all
foster homes certified by the department to private child-placing
agencies, ensuring minimum disruption to the children in foster
care and to current foster parents;

Rep Talton wants gays banned from becoming foster parents. CPS requieed to ask the sexual orientation of potential foster parents-if foster parents answer yes to being gay, they will immediately be disqualified.

Section 264.1064- Foster Parent Disqualification- (a) The department shall require an applicant to serve as a foster parent or a foster parent whose performance is being evaluated by the department to state whether the applicant or foster parent is homosexual or bisexual. (b) if the applicant or foster parent states that the applicant or foster parent is homosexual or bisexual, the department may not (1) allow the applicant to serve as a foster parent (2) place the child with the foster parent....

"Those of us that are in the Christian movement believe it's a learned behavior," he said of homosexuality in explaining his reasons for the measure. After several minutes of debate, Talton's amendment passed, 81-58.

Currently, CPS does not ask about a foster care parent's sexual orientation. But the issue has come up before. In 1998, a CPS caseworker in Arlington removed a child from the care of his foster parents, a lesbian couple, because she thought the couple's lifestyle was inappropriate. The caseworker was later demoted

We find it unsavory for the government to ask citizens what their sexual orientation is, as if it was a criminal issue that disbars them from being parents.

The provision to disqualify gay and bisexual Texans from foster care was put forward by Rep. Robert Talton, R-Pasadena, who argued that youngsters' sexual orientation is likely to be affected by that of their caregivers.

"What I'm trying to protect them from is learned behavior," Talton said. "I think we should expose them to the straight life as much as we can."

Several Democrats pounced on the remark.

"Is homosexuality catching?" asked state Rep. Garnet Coleman, D-Houston.

State Rep. Mike Villarreal, D-San Antonio, questioned whether state officials should be required to determine an applicant's sexual orientation.

"How could we check your sexual history?" Villarreal asked state Rep. Bill Zedler, R-Kennedale, a supporter of the provision.

What's next? A Peeping Tom provision so that, indeed, one's sexual proclivities can be investigated from the bushes outside the bedroom window?
