HPV- Finally- Texas State Senators Nelson and Keffer Ask AG Abbott- Can Perry DO THAT?

It's been my contention since last week, when I saw while on vacation that Perry had deliberately bypassed the legislature on the bill mandating HPV vaccinations for 12 year old girls, that he has no authority, as head of the executive branch, to make law by issuing an executive order that doesn't simply affect his own branch, but all citizens of the state. (And it DOES affect us all, in that WE would pay for all the expensive Gardasil vaccinations.) I've also been severely disappointed, as a Democrat,  to see that Chris Bell supports these mandatory vaccinations, and shockingly, supports Rick Perry. I fail to understand why any Democrat would want to be on the side of this particular mandatory vaccination and also not speak out AGAINST Perry's monarchical decision. The action by Chris Bell throws him off my list of anyone I would support in the future running for an office that affects me.

At any rate, kudos to Jane Nelson and Jim Keffer.

Some lawmakers, led by Sen. Jane Nelson, R-Grapevine, and Rep. Jim Keffer, R-Eastland, have criticized the order as subverting the legislative process and the child-parent relationship.

Ms. Nelson and Mr. Keffer asked the attorney general to clarify whether the governor can even issue an executive order and, if he can, whether the order can direct a state expenditure, such as the $71 million that might be required to provide the vaccine.

P.S. I think it's unfortunate that Democrats such as Chris Bell choose to side with Perry on this issue-do prominent Democrats REALLY want to be associated in people's mind with this? Comment from the Houston Chron blog:

Dennis - you must not have any young daughters. I have 3 under the age of 15. FIRST, the vaccine is new enough that I haven't seen compelling data to prove to me the safety of the vaccine long term. SECOND, I have 2 health care professionals in my immediate family and 1 of those is an HPV sufferer. Everyone in my family, liberal democrats and conservative republicans alike, agree this vaccine is too new and untried to make mandatory for little girls. THIRD, I'm not prepared to take off from work, pull my daughters out of school, and visit the doctor TWELVE TIMES and pay the 12 co-pays it would take to complete the 4 round course of vaccines per daughter. FOURTH, why aren't boys targeted as well? The only hope of eradicating a disease by vaccine is to vaccinate everyone. How could it possibly be medically and scientifically correct that the vaccine works only on girls? FIFTH and finally, as Americans, we must have time to study and sift through information, and given the correct and proper information, allow our lawmakers to represent us in the normal avenues of legislation -- there is no need at this time for an emergency mandate forcing our 6th graders to undergo a vaccine. The Great State of Texas is not a police state.
