HPV-Perry Takes Off the Crown and Admits the Legislature Can Trump his Executive Order

7 February 2007 at 8:58:04 PM

Maybe he was starting to believe the rumblings of impeachment? Anyway, here's some background.

Gov. Rick Perry's office put the anti-cancer vaccine debate in lawmakers' hands on Wednesday, saying they have the power to trump the mandate he issued last week.

Lawmakers are welcome to try to pass legislation that would bar any inoculation requirement for schoolgirls, said Perry spokesman Robert Black.

The governor could then veto that measure, but lawmakers would have the final say if the Legislature were still in session and two-thirds of both the House and Senate voted to override it, Black said.

"If the Legislature feels strongly one way or another about preventing cancer in young women ... they should act on it," Black said.

This is the first time that the governor's office has acknowledged that the Legislature has the power to supersede his mandate. It sets up a difficult vote for lawmakers who have said they support a vaccine requirement but oppose Perry's action.

Seems to me it isn't just that they can trump it AFTER over-riding his veto-he shouldn't have issued an order that was the effect of a law IN THE FIRST PLACE. Let's go, lawmakers!

P.S. After thinking it over some more, the crown is STILL firmly on Mr. Goodhair's fluffy head and will be as long as people are misled by what seems to be sleight of hand to NOT acknowledge that he had no business in the first place making law from the executive branch.
