Pretty awful story that involves Exxon-Mobil paying little to no attention to complaints of people who live in the country. 

The Lemons said they have tried for two years to talk to officials at Exxon about their concerns of health risks as well as the general disruption caused by the gas transfer station on their land and nearby drilling. Although they received compensation after filing complaints with the Texas Railroad Commission and meeting with local Exxon employees, they said they have been unsuccessful in their efforts to maintain a dialogue with Exxon about operations that directly affect them.

The Mayos said they went from "country living to living in an industrial park, overnight."

A gas compressor station was constructed for Samson Lone Star LP approximately 1,400 feet behind their home. Four large engines run day and night.

"We endured the drilling of more than 40 gas wells in close vicinity to our residence and related truck traffic," they said. "But that was nothing in comparison to the constant noise of the gas compressor station."

Here's the problems. You buy a nice piece of property in the country, maybe you think will retire there. One day you wake up and find surveyors from the Oil and Gas companies walking your property preparing to see how they will drill it... because YOU DO NOT OWN MINERAL RIGHTS (or you share owning mineral rights with others who also have a say in what an O&G does with YOUR property).

The issue of surface rights vs. mineral rights.

"Those who have mineral rights have dominance and by law have the right to freely use the surface estate to the extent reasonably necessary for the exploration, development and production of the oil and gas under the property," the Lemons said. "With limited exceptions, this activity can be done without getting permission from the surface owner and without restoring the surface or paying for any non-negligent damages it causes."

Second issue: What do you do if the O&G companies are screwing up and you want them monitored? Don't look to the Texas Railroad Commission to be on your side.

The complaint process for oil and gas activity. The Lemons said drilling operations are "self-monitored."

"Complaints made to the Texas Railroad Commission are first taken to the oil/gas companies so they can remedy the alleged problem before an investigation occurs," Lemon said. "In many instances, the TRC simply does not have the responsibility, and it is difficult to ascertain what other regulatory agencies to contact with concerns."
