when I attemped to see the latest one, I was denied by the Texas Attorney General Public Information office. What was interesting about this decision, seen below in the PDF file, was that Ray Reynolds, CEO of Glen Rose Medical Center (Somervell County, Texas) did not follow the procedure to get a timely opinion from the Attorney General office after I submitted my request. I had pointed out to the AG's office that because he had not attempted to contest this, the information was presumed to be public. Also, even more telling, for almost two years, both the Joint Commission and Teas DHS reports on Glen Rose Medical Center were publicly available for viewing and/or download on the Glen Rose Medical Center website, put there presumably by Ray Reynolds or one who works for him. (Information included a HPPA violation from a patient from Pecan Plantation in Hood County, Texas). Despite this, because there was a previous opinon referencing Humana Hospital Corporation v Spears-Peterson, Glen Rose Medical Center was able to withhold the information on the basis that the Joint Commission is a medical committee and its accreditation report of a hospital is confidential under section 161.032 of the Texas Health and Safety Code. Why they did not do so before, when the reports were available publicly on the internet, makes it appear that it was perfectly fine for Somervell County residents to know the contents of the JC report before but now ... why not?
It's unfortunate that, especially when there have been serious problems with safety in the past, taxpaying citizens cannot know whether GRMC has, in fact, fixed its safety issues by seeing primary documents such as the JC report. The Joint Commission report does not list specific patient data so does not violate HPPA law. There is an ongoing case against Somervell County Hospital District and Ray Reynolds by the Turks regarding freedom of speech and safety issues.
