Why Is Arrogant Somervell County Hospital District SITTING on Dissolution Petition

Listen to the following snippet from the special session Somervell County Commissioners/Somervell County Hospital District meeting from Tuesday, Nov 5, 2013. Note that the Somervell County hospital district attempted to prevent Paul Harper from giving the petitions to them during an open meeting, saying that it was not the agenda.  The board was trumped after a few minutes by their attorney, Kevin Reed, chiming in and telling Harper to give the petitions to Ray Reynolds after the meeting. Reed, who is one of the principals in Reed,Claymon, Meeker & Hargett said "You can just give it to Ray today and we can start the process. If you meant to go and do that, that's fine, and if it's done and ready to be given to Ray, we can start the process".

First, Somervell County Commissioners Court did NOT give the petition to the elections supervisor, Cathy Thomas, who has been TRAINED in elections, petitions, etc, and who actually is the same person that processed the Somervell County Hospital District PAC (in 2 days). What DID they do with it? If they are having the attorney process it, is this something that Somervell County taxpayers are footing the bill for? One thing is certain, as of yesterday afternoon, the District had not even attempted to get a registered voter list to compare signatures against. Is it even appropriate or ethical for them to attempt to verify the signatures themselves, when they are not familiar with the election law in the same way Thomas is? What a collossally bad idea.

Second, on the Texas Open Meetings Act. The way governmental meetings are supposed to be presented is per the agenda sent out for public viewing at least 72 hours before a meeting. Why? So that the taxpaying public can decide if there is something on the agenda they particularly want to hear. If an agenda has, for example, a public comment section, or is a public hearing, you would then KNOW that you are able to go and have your opinions heard. If there is not a public comment section or anything else that indicates that you have a chance to participate, not only do you have the expectation that you cannot, but you might not go to the meeting on that basis. IF then the governmental entity arbitrarily decided to ask for public comments or questions, they would be violating the TOMA by not spelling out that's what they are going to do. Further, it is capricious to decide on the fly IF you will allow public comment or discussion (or a *question*, as Larry Shaw had it here).

Take a look at this agenda. Is there a public comment section? No. Is it called a Public Hearing? No. Is there anything to indicate that they will be taking public comments during the meeting? No.

We remind as well that Judge Mike Ford has taken upon himself to decide IF people will be able to speak during a public comment section that IS on the agenda, but more than that, IF someone wants to speak up during and it's NOT on the agenda, he has had no problem with telling people that not only will he not allow them to speak but telling them WHAT they can speak about.

See my point? When a meeting is run capriciously and arbitrarily, according to the whims of the people running the meeting (which in this particular instance calls out the arrogant Somervell County Hospital District Board, not only is TOMA being violated, but the board members are disrespecting Somervell taxpayers.

Do we really expect any less from this self appointed dictatorship to follow any rules today , from my obsrvations with this mafia (Methodist)  have folloed few if any rules , mandates , statuates or laws since thier inception why would they bother to do so now .I belive they have a seperate agenda beyond our (Somervell county citizens ) best intrest , they for the most part came from other areas and want us to become the places thay got ran off from.
