NOTICE OF MEETING

CITY COUNCIL OF THE CITY OF GLEN ROSE

MAY 24, 2010 - 5:30 PM

COUNCIL CHAMBERS – TOWN HALL

THE CITY COUNCIL OF THE CITY OF GLEN ROSE WILL MEET AT 5:30 P.M. ON MONDAY, MAY 24, 2010, IN TOWN HALL, 201 NE VERNON STREET, TO DISCUSS AND POSSIBLY TAKE ACTION ON THE FOLLOWING ITEMS:

AGENDA:

 

  1.   Citizen Comments: This is for citizens to comment on any subject concerning city business that is not on the current agenda.  Members of the Council may answer direct questions, but no action may be taken at this meeting.
  2. Approve minutes of previous meeting(s).
  3. Proclamation declaring the month of May as Motorcycle Safety and Awareness Month.
  4. Discussion and possible action on continuing the process of hiring a city administrator.
  5. Rescind bid award for street work on Summit View and Longhorn Streets. Re advertise for bids.  
  6. Discuss cancellation of interviews for the City Administrator position and possibly take action to reset interviews and notify candidates.        
  7. Discuss interview process for City Administrator and staff and council members to be present during interviews.
  8. Consider and appoint 3 new 4-B Board Members for a 2 year term. The members whose terms are finished are Ronald Bruce, Chris Bryant and Connelly Miller.
  9. Report on Oakdale.
  10. CVB report.

On the rescinding bid (#5), this is because THEY NEVER TOOK THE AD OUT IN THE PAPER!!!
I find it strange how Jimmy Gosdin knew to submit a bid (the only bidder) since it was never published in the paper.

So when Ricky Villa asked TWICE if the invitation to bid had been taken out in the paper, Ronald Bruce said "Yes" and expanded on his answer to say "it ran for two weeks" which I consider a blatant lie.
If you are going to just say yes that is one thing to confirm but to expand on that answer to add something to it shows a purpose to mislead the city council.

On #6- the city administrator interviews were cancelled, as per comment from texlib here. I had asked for the letter or email notifying the applicants, didn't get because there was some confusion about how that happened. One of the city council people asked the committee (that has Larry Shaw on it)  that was arranging the interviews to wait to do them until after the new city council meets, so the people in the interviews were notified that they were cancelled. It appears there is some ambiguity about whether there will BE interviews or if the new city council may decide not to hire a city administrator.  At any rate, the interviews were purposely cancelled and not because, say, there was an illness or other unexpected occurrence.

It seems from the lack of information and first hand information that one person, possibly an unnamed city council member is able to make a decision. Was this done in an executive session? If so, the council took action in executive session and not in open session as the law requires to instruct the search or screening committee to cancel the interviews. A question should be asked if the executive session was appropriate. Usually a decision such as cancelling interviews is not a topic for an executive session since a specific and current employee was not the subject of the session. If the session was for consultation with the attorney: then, the city attorney must be present for  an executive session on the legal exception. Just an observation: Does anyone in the city understand the open government laws  of the State of Texas? They are not difficult to follow or understand. A governing body is obligated to follow these laws. If the city council cannot afford to pay an attorney, advice is always available from the District Attorney, the State Attorney General's office hot line, or if the city is a member of the Texas Municipal League, an elected official of authorized staff member may call the legal department at TML in Austin for advice and direction. A new city administrator if he or she is trained, understands open government and transparency, and has the interests of the council and community in mind will see to it that the open meetings and public information laws are followed by the book. It is in everyone's best interest.

@texlib-So with you. I've been mowing for the past hour and thinking about those dang interviews being cancelled AND that one city council person told the committee to stop the interviews. On whose authority? Since I can't find ANY evidence that this was done in open session (and we have recorded the last two meetings) and it's not explicitly on any agenda, AND there was no letter/email/notice FROM city council, AND since I doubt that the city council member would have acted unilterally, it almost certainly had to be discussed in executive session. I just looked back at the Glen Rose Reporter from last week to see if there was mention of it.. nope.

On open government. If you've been following our site, you must have seen that we have posted multiple open government violations.  Currently the mayor has never followed the law by taking and keeping on file the open government training certificates, even after being asked recently. The city, in our opinion, has had a habit of going into executive session and discussing open meeting agenda items, has held a meeting even though a notice wasn't present, has had email quorums about city business, etc etc etc. And they do have an attorney, on contract I believe, but not sure, but he has not on at least two instances that I am aware of , spoken up about their violations (one, for example, where they met offsite and took no minutes nor recorded the meeting and he was sitting at the front with the council members).

I absolutely agree with you that a city administrator would be key.

My bet is that the postponement for hiring a city administrator is the mayor's idea. I'd also bet she has a very specific agenda concerning this.

Final word on #6. Not discussed in city council, not on agenda,  and apparently not also in executive session. City council member who is also on the search committee brought it up at their meeting a week or so ago, and apparently not at anyone's behest, at least not formally. Why this was done outside of a city council meeting to be discussed as #6.
