Religious News and Notes from the Distaff Side for March 2 2010

YOu know that 77 foot cross that was subject of a dispute in Kerrville? Settlement reached and it's going up!  I suspect the homeowners were going to lose because the man had brought the property pre-the subdivision.

State District Judge Keith Williams says the issue was property law, not religion. Some zoning provisions capped structures at 40 feet.

What about religious activities, such as feeding the hungry, on public land?

City officials say they've never disagreed that the church is doing good work, but that it's operating as a charity dining hall in violation of zoning laws. The church is on a busy street, lined with homes with well-manicured lawns.

Ten Commandements monument in Haskell Co to come down.  Supreme Court lets decision by lower court stand.

Local resident James Green and the American Civil Liberties Union of Oklahoma filed suit in federal court, alleging that display of the Ten Commandments on public property is an unconstitutional endorsement of religion by the county commissioners who approved the display. A federal judge held a two-day trial and disagreed, ruling that the county commissioners had a secular purpose of acknowledging the historical significance of the Ten Commandments.

The judge ruled that under an existing 2005 Supreme Court precedent in a Texas case, the display did not amount to an unconstitutional endorsement or establishment of state-sponsored religion.

A panel of the Tenth US Circuit Court of Appeals disagreed. It ruled that the display was an endorsement of religion and thus violated the First Amendment’s prohibition on excessive church-state entanglement.

Geez. I hope they appeal this.

School board was breaking the law. They settled.

In part, the settlement says school officials shall not “promote, advance, endorse, participate in or cause prayers during or in conjunction with school events for any school within the school district.”

It also says that school officials shall not “orally express personal religious beliefs to students during or in conjunction with instructional time or in conjunction with a school event.”
