Commissioners’ Court of Somervell County met in a regular meeting at 9:30 a.m. on the above date with all Commissioners present.  County Judge Walter Maynard presided.

OPEN MEETING

CITIZEN COMMENTS:  Kathy Moss thanked the Court for handling the re-dedication of the Cpl. Rhett Butler memorial in Heritage Park on July 20, 2009, and for keeping the family informed.

DISCUSSION ON AGENDA ITEMS

14. No proposals were received for the Surplus Property at the Hospital.  No motion.
18.  & 19. Judge Maynard withdrew these items from the agenda.  No motions.

MOTIONS ON AGENDA ITEMS

ITEM NO.

1. Motion was made by Commissioner Ford and seconded by Commissioner Cummings to approve the previous Commissioners’ Court minutes of July 13, 20, 27 and August 3, 2009. Motion carried. All voting aye.

Motion was made by Commissioner Wirt and seconded by Commissioner Barnard to move:
2. $2,000 from Waste Transfer Station Heavy repair Pts/Supplies #400-354 to Waste Transfer Station Eq/Furn #400-570.
3. $635 from COA Property Insurance #420-410, $1,165 from COA Bldg Vendor Maint #420-450, and $5,900 from COA Utilities #420-440 to COA Admin Fees #420-402.
4. $3,000 from Fire Dept Gas/Oil #429-330 and $4,500 from EMS Gas/Oil #436-330 to Fire Dept Uniforms #429-455 $3,000 and to EMS Uniforms #436-455 $4,500.
5. $2,500 from Fire Dept Fire Vendor Auto/Eq Repair #429-451 to EMS Vendor/Auto/Eq Repair #436-451.
6. $80 from Constable Postage #414-310 to Constable Computer Supplies #414-312.
Motion carried. All voting aye.

7. Motion was made by Commissioner Barnard and seconded by Commissioner Ford to approve the remainder of County bills.  Motion carried.  All voting aye.
8. Motion was made by Commissioner Cummings and seconded by Commissioner Wirt to approve the County Treasurer’s report.  Motion carried. All voting aye.
9. Motion was made by Commissioner Barnard and seconded by Commissioner Ford to approve departmental reports as submitted.  Motion carried. All voting aye.
10. Motion was made by Commissioner Wirt and seconded by Commissioner Barnard to approve terminating the County burn ban.  Motion carried. All voting aye. 
11. Motion was made by Commissioner Barnard and seconded by Commissioner Wirt to approve terminating the pilot program and reinstating the previous Waste Transfer Tire Policy and rates.  Motion carried. All voting aye.
12. Motion was made by Commissioner Ford and seconded by Commissioner Cummings to take under consideration two bids for Concrete and bring recommendations back to Court.  Motion carried. All voting aye.
13. Motion was made by Commissioner Ford and seconded by Commissioner Barnard to take under consideration two proposals for Expo Center Concessionaire and bring recommendations back to Court. Motion carried. All voting aye.

Motion was made by Commissioner Wirt and seconded by Commissioner Cummings to approve specs and advertising for
15. Seven Triplex mowers, and
16. Crushed Stone;
bids due at 5 p.m. on September 11, 2009, to be opened at 9:30 a.m. on September 14, 2009.  Motion carried. All voting aye.

17. Motion was made by Commissioner Ford and seconded by Commissioner Cummings to rescind the Court’s action (July 13, 2009) to participate in the NACO Prescription Card Program.  Motion carried. All voting aye.
20. Motion was made by Commissioner Cummings and seconded by Commissioner Ford to approve Change Order #5 Hospital Construction Project Contract at $195,181. Motion carried. All voting aye.
21. Motion was made by Commissioner Wirt and seconded by Commissioner Barnard to approve the Interlocal Cooperative Contract for Road and Parking Lot Paving Services between Somervell County and Somervell County Water District, and authorize the Judge to sign.  Motion carried. All voting aye.

There being no further business, motion was made by Commissioner Cummings and seconded by Commissioner Wirt to adjourn at 10:06 a.m. Motion carried.  All voting aye.
