Wyoming Families Sue School Over District's Random Drug and Alcohol Testing Policy

12 July 2009 at 9:00:56 AM

on grounds that the whole policy is unconstitutional. I didn't realize till I read this that the policy is written into No Child Left Behind Law. Sheesh, is there anything that NCLB doesn't include?

The Goshen County group bringing the lawsuit said the policy violates the 4th Amendment protection against unreasonable search and seizure. The lawsuit also claims the policy violates the 14th Amendment’s equal protection provision by treating students involved in activities differently than students not involved in the extracurricular activities.

Hugh and Lee Hageman are among the parents who filed suit against the school district. They said they have supported school activities over the years, and the students shouldn’t be forced to submit to drug testing.

“We don’t want this (drug testing) for our students,” Hugh said. “It’s time we stand up and fight for our freedoms.”

Here's my take on *random* drug testing, as discussed about GRISD's policy.

I agree, Salon, completely. Some years ago I had to participate in the collection of urine samples for drug testing at a school district. The process is degrading to the child and even frightening to some. It teaches them nothing about  developing responsible behavior and is used as a crutch by parents who won't do the hard work of raising a child. It also teaches them to always bow to authority, rather like robots, which is questionable. Drug use among our children should be treated by parents as a medical problem instead of burdening our schools. One thing of concern I noticed about these children was how many of them were on prescribed psycho-active drugs. Also, drug testing is a very lucrative business and produces huge amounts of non-biodegradable waste.

I also resent the level of drug testing by employers. Illegal drugs, of course, are not acceptable but legal pharmaceuticals are OK. I have had many experiences on the job with co-workers who were too compromised by 'medication' to function properly.
