Prior to the last Primary Election (my first as a Chair) I discovered a flaw in the Texas Election Code which allowed someone through a series of circumstances to be the judge of their own primary election. After discussing it with the Secretary of State's office and getting their input, I approached my Texas House Representative Sid Miller. Rep. Sid Miller was very helpful in working with me to completely understand the issue and put legislation together to address the problem. The legislation he introduced into the Texas House was HB 567.

HB 567 was sent to the Elections Committee where I testified, along with Rep. Sid Miller, about how a precinct chair was actually the election judge of their own election (name on the ballot with a challenger but in charge of ballots and equipment) in our last Primary Election. HB 567 passed out of the Elections Committee unanimously and was then sent to the House floor where it received 144 yeas, 0 nays, and 1 present who did not vote (speaker).

In the Texas Senate HB 567 was sponsored by Senator Fraser at the request of Rep. Sid Miller. I did approach Senator Kip Averitt's office about it and Joshua Meeks from that office assured me they were in communication with Senator Fraser's office offering any support they could. It was sent to the State Affairs committee where it was passed unanimously (9 ayes, 0 nays, 0 absent, 0 not voting). On the Texas Senate floor, HB 567 was approved by a 29-1 vote sending it to Governor Perry's desk.

On May 27th, Governor Rick Perry signed into law HB 567 and it will become effective on 9/1/09.
